The kid was well within his first amendment rights. He did nothing to warrant arrest. The kid had worn the shirt for over half the school day and was at lunch when the teacher came up to him and told him to change the shirt or turn it inside out. I find it hard to believe that he was disrupting the educational process for half a day before anyone confronted him about it.
The teacher personally did not like the message and decided to make a stink about it.
The shirt did not violate the school dress code,( ·  Clothing and accessories that display profanity, violence, discriminatory messages or sexually suggestive phrases are not to be worn at school or school functions.

·  Clothing that displays advertisements for any alcohol, tobacco, or drug product is not to be worn at school or school functions.)

 it did not promote violence or a violent act, was not sexually suggestive, or vulgar. It stated a political message. If that stating a political message is not permitted then they should also ban all Obama, Nelson Mandela, Bob Marley, and the endless list of other shirts.
If everyone is thinking alike, someone isn't thinking.
