Wrong, You can file suit in civil court and have criminal action. Civil and criminal are considered separate sovereignty and it is not double jeopardy nor is it barred under Res Judicata. Small claims Vs. Civil is going to depend on how much is owed to you. That can be considered by state law which you will have to look it up based on your state or contact an attorney. I would say talk to an attorney.
