It is kind of a stretch,,,,,,,,,,,,,,,,,,,You have to pick one situation and abandon the other (I think...this is free, non lawyer advice.).................EITHER you assert (insist and demand) that you were treated as an employee even though many aspects of your paperwork named you as a contractor. Then you demonstrate you were actually an employee all the time and when separated from your employee position (1099 job) through no fault of your own. This entitles you to unemployment compensation (UC). Even if this stage works you will probably need to have a previous work history with enough employer contributions to generate a UC claim with payments to you......................OR you can defeat the background check. Insist and prove the background check produced information about another person and they are, in error, confusing you with that other person. You could also get any true record of past events expunged by the courts and then show the new (cleared) record to DISH or Directv and reapply...............YOU GET TO PICK A PLAN...........good luck.................take all this to a lawyer with any background history...............Joe
