Joe has it right, if you try to go the employee route, you could stir up a lot issues for the company, so be prepared for that. There was a case here in Dallas with a TWC cable sub that was fined like 20K for classifying its techs as subs, but treating them like employees, all it took was 2 of the techs going to the IRS>
