Don't take this the wrong way, and I agree with everything you say, but if he is going in as a contractor, then he has hardly any laws to protect him, EEOC only affects employment, not 1099 contractors, and if he is in texas, or in any state that is a 'right to work' state, then the employer can simply say we don't want to hire you, with no reason whats so ever, they can also fire you, for no reason needed.
