Not sure what you disagree with. Documents like the DOI and the Articles of Confederation were drafted before the Constitution. Once the Constitution became the law of the land, all other documents, binding or not, became pretty much useless in regards to the law.
The DOI is mostly used to argue the intentions of the founding fathers. As you stated, the DOI stated the people should have the right abolish a self destructing government. In that spirit, the Constitution was drafted, and it include provisions on how the People can legally abolish a bad government.
