The law comes from legislators. The court is often overturned by another court or if it makes a mistake. In this case, if the court rules against the constitution then it is a mistake as my other post shows it shouldn't hurt anyone anyway and goes against first amendment rights.
Many times judges try to legislate from the bench. That is not their job and judges are people who often use personal feelings instead of interpreting the law.
I see what you are saying.......sometimes it doesn't work, the system that is. But I still think the US has the best justice system when people use it. I don't know if we can have everything black and white all the time, there has to be some gray area. You make some good points though.
