What you say is correct but here is one small caveat. Legislators write laws, but the laws are supposed to be grounded in the Constitution. One of my beefs with most of what comes out of DC is I can't for the life of me understand what clause of the Constitution permits congress to actually pass the laws they are writing. And when asked you get the livivng document bs or the interstate commerce clause. No where in the Constitution does it say it should be interepted any other way than exactly as written. So I whole heartedly agree with you about the judges who legislate from the bench. That is the exact reason why Supreme Court Nominees are so important.
