I have a stupid question this Employee Misclassification Act, sound like it should be a good thing. I was wondering could a prime contractor inform a sub-contractor what kind of tooling and machine's he wants used while doing the needed work. My gripe is that I am currently open trenching all my work with a mini excavator and i bought a sit down trencher but the prime indicatd to me that I could not use that machine, but in the contract I signed it say's that the conduit can be placed in the ground by any means nessecary.
