You wouldn't want the companies to obey the law completely.
If they did, they would be forced to stop using contractors and make everyone inhouse. This would drive the cost of business through the roof and further rate cuts to make up the difference. Being a sub contractor is a still good gig for the tax benefits alone.
The smart subs are paying less taxes than in house while making double the pay. It's a matter of playing the game to benefit both parties.
