Valid points, but make sure you understand we are talking about employees. Not contractors.
Its a little confusing because most install companies have workers they classify as subs, but the law says they are employees. They save tons of money by doing this, which can be argued allows them to low ball other companies who follow the rules. Now, how likely is it that a business ,who under bids to get a contract, then breaks the rules managing the contract by mis classifying workers, is going to be the best company for an installer to work for compared to the companies who follow all the rules and lose the bid on contracts to the companies who cheat and can underbid.
If you are a classified as a contractor by your company, but, if have to report in everyday at a location, if your jobs are given to you pre scheduled AM or PM, if the install company trains you how to do the work, and if the company has the final responsibility with problems that arise from your work, you are an employee and are eligible for OT on piece work.
This aint me talking, its the law.
