Also, what is this ultamatum you speak of. You act as if only managers are bound by the contract. And you are right. Unions usually arent with people who are happy, thats usually why workers choose to organize. They arent happy. And the workers have to be just as careful not to deviate from the contract as the suits. If you as a manager deviates from the contract, a grievance is filed and if it is found that the manager was in the wrong they grievant is made whole. If a worker deviated from the contract he is open to suspensions, firings, and warnings.
Theres usually nothing that stops managers from communication with their unionized workers. In your example the problem was not lack of communication. Its was the lack of having the right to circumvent the rules at will. I know Trey was probably your favorite employee in your example, but the rules are there for everyone to follow. Just like the real word. The rules are to be obeyed by everyone.
