Before I started cable, an employer of mine was audited. The IRS has a list of twenty some questions and if you answer yes to ANY of them, you are considered an employee.
If you have to be at a shop or office at a certain time avery day, If you are instructed how to do the work, If you do not have a contractor's license, If you work for only that one contractor for more than seven months out of the year.... you are an employee... no mater what you have signed.
Bitch of it is, My employer got stuck with paying ALL the taxes-Federal, State, SS, even workmans comp... all on contracted 1099 subs. The IRS said he was responsible since he had not withheld said taxes...
Contact the IRS to be certain things are still the same... that was a long time ago...
