You might want to speak to an attorney with knowledge of employment law.
26 USC 7434 allows an individual to bring a lawsuit against "a person [who] willfully files a fraudulent information return with respect to payments purported to be made to any other person." A 1099 is an "informational return" covered by the law.
If a person sucesfully brings a claim under 26 USC 7434 they are entitled to the greater of $5,000 or a combination of actual damages (which include costs to fix any problems that come from the fraudulent returns), costs of the action, and attorney fees.
