Every state is different + I am not a lawyer'........my experience in MD has neen that with either the civil "sue 'em" or "have 'em arrested" you have to prove they broke a law or contract. The civil court approach is easier in that the judge will look at a contract or come to understand what the working relationship was and then render a decision. He may agree with you and award damages & collection costs. He may not agree and even award money to the guy you sue (rare). But that is just a decision...you have to find the money and collect it................The criminal approach is different in that you have to show a dishonored check or some proof you were tricked into working and never got paid. Things like someone scheduling you to do installations when they have no money to pay you or paid themselves but not you..........Someone swears out a warrant or complaint...........it is evaluated by a State's Attorney ............and if they agree a crime has been committed they go arrest the guy........The SA may decide it is a contract dispute and not act. He may decide you need more evidence or other proof....or other similar situations. But IF you get as far as the cops putting the cuffs on....if there is any money around you will probably get it. This is called restitution before trial. Your guy could still go to jail for theft of services or something but if everybody is paid...it may end there...................Every case is different.
