Everyone...and I mean EVERYONE. should make a phone call, or two or three and send emails to their state labor department about the chargebacks, on-time quarantees, time slots and eventually the state will start looking into the contractor-vs-employee status. I recieved a notice from the state yesterday, after making enough calls and sending enough emails. The form has 12 questions

1) Do you own and operate your own business independent of this employer?  2) Do you have the ability to choose which jobs you accept, including when and wher to perform the work?  3)Are you paid by the hour or by the job?  4)Are you allowed to perform work for other contractors? 5) Are you required to provide/purchase your own tools, supplies and materials? 6)Are you permitted to hire anyone you want to work with you on the job? 7)If additional materials/supplies are need, do you purchase them from vendor of your choice? 8) How do you feel it is determined that someone is a contractor rather than an employee? 9) Do you feel you are misclassified as a subcontractor by this employee? 10) Were you issued a 1099 or a W-2? 11) Please provide any additional information you feel may be helpful or will add to your answeres above. 12)Please provide a list of all subcontractors used in the last 12 months. Also fill out the contractors you have worked for in the last 12 months.
