You know what, cables, had asked if he could change companies as a contractor/ 1099 employee. Problem/ companies hiring you as contractor and when you want to jump ship, they claim you are employee, so they can lead you around by the balls. Then when you want to pursue employee benefits they then claim hes a contractor. So any one who has a question, this is what you do, Including cables. File a form SS-8 with the IRS, with this form submit your sub contract labor agreement and your 1099's to the IRS. Let them determine if you are contractor or employee. If they say you are a contractor, jump ship. If they say you are an employee send a report to the state tax authority, that states Department of Labor, the U.S. Department of Labor, that states Industrial Commission, and a tax fraud report to the U.S. IRS. That way you can get your overtime and get paid for any equipment they charge you for. You can't legally have the best of both worlds. I am including a link to the forms. http://www.irs.gov/pub/irs-pdf/fss8.pdf, http://www.irs.gov/pub/irs-pdf/f3949a.pdf http://www.texasemployerhandbook.com/2011/01/employee-vs-independent-contractor/
