If you needed to be certified and pass any sort of background checks and testing to get it and somebody else is using it for financial gain it is criminal. It may be that nobody has taken the steps to have it prosecuted in that manner, but it's like taking a certified electricians number and posting it on your business cards and van and then doing work you are not certified for.
