Nice rant, I guess you made some mistakes in your past and are having a hard time getting hired, there is no other reason for you to wast your time and everyone else that reads this. Anyone can quote law but that doesn't mean you know what your talking about. As the owner of several companies in this industry in several states I can assure you you are incorrect. 95% of the time background checks are accurate, the only time we have found errors with a background is if someone's social security number has been compromised and if that has happened you have bigger problems than not getting hired by a contract company. There is also the real possibility that a company just doesn't want to hire you. Why would anyone tell a potential new hire they weren't going to be hired because of there background, companies don't owe anyone a reason that they won't hire them, we don't need your services is more than is needed in my book. Why would a company want to hire someone with major issues on there background (it does take major issues to not get hired because of a background check), or hire someone with major credit issues,  if you can't manage your own LIFE why would anyone trust you to manage thousands of dollars of equipment, and customer contact, and being in customers homes. Quit trying to threaten lawyers, and quote law. If you know a lawyer that would even talk to you about this none since give me there number so I can hire them to go after some of the MSO's that have short paid me over the years. By the way if you put no for the question about being arrested and you have then you are an automatic no hire for lying on your app. that looks real good to potential employers.
