They can, and some do.  As long as you get at least minimum wage at the end of the week for your 40 hours, they are not breaking any rules.  As long as they make you aware that they are doing it at the time of hiring.  It sucks big time, but if you are failing QC's you are putting your entire shops jobs on the line.  I have been employed with several different contractors, and have had the pleasure of working with some really good guys who do FANTASTIC work, then a couple newbies come in and dont want to put the effort into their jobs and start making the whole place look bad.......If you are failing QC's ask for some additional training.....the only person that is responsible for your quality of work is you.....
