It's not a prediction, It's a what if scenario. Let's suppose that no fund was setup and BP went under. Everyone would be complaining that the government should have made BP set up a fund because we, the taxpayers would be held responsible for paying for the clean up.

By BP's own worst case scenario provided by internal documents, there could be as much as 100,000 barrels of oil leaking per day.  Even if they stopped the leak today, there is still alot of oil floating around in the Gulf just waiting to wreak havoc.

BP is solely responsible for paying all legitimate claims. This includes lost revenue for employment, tourism, etc..... No doubt that there is going to be people who want to make a buck off of this tragedy by filing false claims. That is just the way some people are.

Keep in mind, alot of those people along the Gulf rely on fishing and tourism to provide for their families. You need to put yourself in their situation for a moment. How would you feel if you lost your livelihood due to the negligence of some one else? How would you feed your family? How would you pay your bills?

Keep in mind that the economy is still in the tank and jobs are still scarce.

Everyone that I know down that way is hoping for the best, but preparing for the worst.
