That is incorrect. The fact that the employer/company issued a 1099 and didn't deduct taxes does not determine contractor or employee status. Additionally, if you file an S88 with the IRS and they determine you were misclassified, you will not be responsible for the tax penalties.. it will all be the responsibility of the employer that misclassified you
