if you are given a 1099 and no taxes come out of your check ,then you are a contraxctor period it doesnt matter his truck,gas,material,,etc,,you r still a contractor,,now if he takes out taxes and pays you by the hour ,then you r an employee,,,,,,,,,,,,,,,,,
