Are you paying the lawyer for all this?
You were working.....laid off....called back & weighed....told you were 32 pounds too heavy? Then you sued them for not allowing you to exceed the load limit of the ladder? Employers must discriminate in selecting employees who are best fit to do the job.
I think your lawyer is in your pocket having a little money snack.
