I know what you are saying!
I was an employer for awhile. I worked for small companies where every little detail made a difference. I have had big companies as clients. It all comes to the same thing. IF anybody is given trust and they have a record of not keeping that trust there is always the question,,,when will this guy fail again?

A good quote on the subject came from a state police commander addressing incoming cadets..."We have found in background investigations that every applicant has some issues in their past that, if discovered and prosecuted, could have  led to a felony conviction and disqualification from  state police employment."

I think the assumption is that if there is one conviction there must have been other (many) other incidents that were just as bad or worse. They were just not caught.

Yes, we all have a right to a presumption of innocence until proven guilty.
No, what goes around is not fair or efficient for companies or prospective employees.
