The states have the power on this deal more so than the fed gov. So says the U.S. Constitution. Period... You have some how gotten it completely backwards. Also, it takes someone to challenge any legislation in order for it to be ruled upon as constitutional or not. (even when the idiots pass it;checks and balances) Case in point; Bill mcCollum current Florida att. general, running for governor. (Although, I don't care for him all that much, even though he was a major proponent of the impeachment of the former lying bastard in chief) McCullum has made it clear that he will challenge either bill if they legally insist participation thereby would be struck down by a federal judge or consequently scotus.
