Everybody always trying to talk about a lawsuit.  I am not sure what paper he is talking about but it is true the phone line does play a part in showing what the customer is watching.  It does not release any personal info about the customer only the channel they are watching.  There is a place somewhere online (I think) that the customer can opt out if they choose to do so.  There is absolutley no legal recourse here.
