Re: California Contractor pay? 1099 or employee?


In California and I think in most other states, when you are doing installs for cable tv, you need to be W-2. Out here,most of the cable contracting companies that do installation work, get sued for Over Time Wages.Thats why they make all their techs employees.

The state looks at it this way: If you are given all the supplies to do the work,your considerd an employee. Therefor, if your working more then 8hrs a day you should be getting overtime. Subcontracting satellite companies get way with not having to W-2 their techs,because they make you pay for all your supplies. I believe in Washington, they have a different policy.

But to apply for your contracting license in California would be a waste of time,unless you looking to start a business. Also there use to be a 5-6 month waiting list to get your license.
