This has been going on in this industry forever. Even the insurance companies of contractors try to put an "employee" tag to the MSO for the contractor's people.
I went through this in 1985 when I was hurt on the job as a sub. My contractor's insurance company tried to make me an employee of the MSO. I was deposed for it.
In the end, the MSO threatened to end the contractor's contract if the insurance company didn't back off.
It has also been applied many times as far as unpaid overtime, since no contractors (paying piece work) used to pay anything extra for extra hours. In recent years the labor boards have cracked down on contractors or even MSO's on not considering this, especially as an employee getting paid piecework.
