It is so easy to start the process it is not funny. IRS form SS 8 gets it rolling. They will then do an investigation of weather or not you are a contractor or employee. And they lean more towards employee because they will bring in more tax money ie social security taxe with no deductions, if you are an employee. I have just done it for a company I built cell sites for and I am awaiting the outcome now.
Ps If you are declared an employee, you get any of the tax money you paid in that the employer should have paid back. So there is an incentive also. It also opens the door to lawsuits for mandatory uniforms tools etc to be reimbursed.
