Better yet, I have a client that was telling us they weren't paying us because the provider said there was unhappy with the 2 cell sites we built for them and he has not been paid because of it. Just got a letter from the carrier and their on site construction manager that their were no punch list or any other deficiencies on the sites and gave us a copy of the check showing the prime was paid. Just for HA HAs on Friday, we called the District Attoneys office, and they opened a case for fraud and embezzlement against the company AND its sole owner. Already been contacted by the prosecutors detectives who are investigating the details.
I love this, because he cant get out of this just by being incorporated or declaring bk. HE cashed the check and did not pay the monies owed. Get convicted, the houses go up on the market to pay restitution. He also gets a conviction on his record as a bonus. No restitution no parole or probation. I would love to be a fly on the wall to see the look on Franks face when the detectives show up to bring him in.
The better thing is, this is going on in two different states, PA and NJ. So it is 2 different prosecutors offices and we got the same result. A word of advice to all of you, keep every email, phone record, letter, mail receipt, invoice and back up peirce of paper no matter how little it may seem. It is what got us in the door on this. And all of this is for right around 20,000 dollars. Not a little amount but not a major case amount either, and they took the cases with general ease. Take it to these idiots, get your day in court on the states dime and ask these genius deadbeat owners " How do you like me now?"
