Vegas is telling the truth. There are criteria used to distinguish employee v contractor. Setting time frames are one.
1-The general rule is that an individual is an independent contractor if (the person for whom the services are performed) has the right to control or direct only the result of the work, and not what will be done and how it will be done or method of accomplishing the result.
2-The determination is complex, but is essentially made by examining the right to control how, when, and where the person performs services. It is not based on how the person is paid, how often the person is paid, or whether the person works part-time or full-time. There are three basic areas which determine employment status:
* behavioral control
* financial control and
* relationship of the parties- IRS.GOV
By setting time frames and scheduling the work, issuing work orders and demanding the person take all jobs you have made him an employee.
As an owner, you don't want to hear that because it increases your liability, but that doesn't make it untrue. Check irs.gov for more info
