But most places it is a violation to NOT have Workers Comp Insurance in force for employee protection. Employers even get dinged for not having the correct worker category in effect. It is usual for the employer to end up paying all medical bills and a penalty for not having the policy current at the time of an injury. You can collect for pain, suffering, disfigurement & lost wages.

Judges know all this but you must tell it to them in court. A lawyer will want a third of any award but may also be worth it.........add legal fees to the amount you sue for or you can't have it.

If you can prove you were dismissed for insisting on something your employer is required to do by law a lawyer can do a slam dunk on the employer. You shouldn't expect to get a huge award and be able to retire but you have a right to expect to be repaired. "made whole" to where you were before the injury.

Write a summary with dates, keep copies of everything.
