If you are subbing in this industry you are being mis classified as a contractor. In reality you are an employee as per the person you "work for" and the company they "work for" deem what materials you are to use, times the jobs are to be performed, type of vehicle you drive, dress code, specifications as to how the work must be performed, enforcing your return to the customers place if the customer was not there but now is ( go backs ) , you are not allowed to work for another prime in the same area on days when there is little work for that prime ( non-compete ), attend meetings scheduled by the prime or MSO, be required to arrive for work on certain days at certain times set forth by somebody other than yourself, your monetary compensation amount and when you receive it is determined by somebody other than yourself, if you have ever received any form of training from the prime, etc.
The list goes on.
Those are some of the questions posed by the IRS to determine if you are an employee or contractor, so one might ponder that OSHA could use the same guidelines.
