I agree with you about Government being the arbiter for every aspect of life. However this is where our opinions differ. If this bill does become law, it will only close a loophole that has been exploited. What everyone needs to remember is that the MSO’s spend a lot of money on lobbyist. It is possible that this bill gets gutted in committee and becomes just another worthless piece of legislation.
Given the criteria set by the IRS/Department of Labor. A contractor will negotiate a price for his/her service. A contractor will provide all tools, equipment, and labor. A contractor will negotiate a time frame, and manner in which the work will be completed. So on and so forth. So to answer your question, yes the prime is a contractor.
Now when that prime sub contracts the labor part of this agreement. Does the sub contractor negotiate a price? No. Does the sub contractor negotiate a time frame? No.
Does the sub contractor have any input on how the work will be completed? No.
So is the sub contractor a contractor? No.
As for the MSO’s hiring all in house. I don’t see how. They are in a fight for their survival, and loosing customers at record numbers to Verizon and Dish. The only prices that will go down are the profits that the primes make. When the prices being offered to the sub contractor barely cover expenses, is their anything left to loose?
