It depends on the state you live in and the laws there. Also if you have a contract and employee handbook that state these guidelines.

In some states like California the employer can not make any deductions form an employee check other then there scheduled weekly deductions for taxes and insurance without permission from the employee. Let’s say you wanted to deduct an extra 50 bucks to cover employees last two weeks of insurance on the way out the door when they leave your company or 100 bucks for tools that were not returned. In California you can not do it. You must take them to court to collect form them.

If you go ahead and deduct it because they owe it and you don’t have it in righting they can go to the state and you will end up paying them thousands in fines and penalties.
