Check with your state labor board, but here in CA, if you hire an employee to do the work, then you also must provide the materials. Tools can be required or available for the employee to purchase (like any other construction trade). Depending on the custom work involved, you might be getting a good deal on the 50-50 split. But the materials issue is flat b.s. The prime or the sub gets paid for providing the materials
