The reason they can 1099 you as well as W2 is because your relationship with the other party is what determines you as 1099 or employee. No one can just say 'Im a contractor'. Thats why I laugh at the job ads they say" its your choice. 1099 or W2 you choose". Thats a joke. Maybe 1 day this industry will get cleaned up. IMO, you would be wise to stay away from the exmaples you see used in this industry. At least 95% of them are bogus.
On 1 project you may be working as an employee, the next project youre working as a sub. Wages earned while working as an employee will be W2'd. Money earned as sub will be 1099'd. Same company, same worker. This is actually the way its supposed to be done. When the terms of your relationship with the company changes, your classification changes.
