Cablepro gave you some good info. In addition to that I would review your local franchise agreement. Also if available consult your government relation person..

In our agreements the city/towns are responsible for their own public channels. I have seen infomercials on those existing channels, but we never set up special channels for that reason.

Our agreement also states they are allow 3 Channels per system Public, Educational and Government and no more than that.
