That statement is partialy true.
Filing a mechanics lien has limitations in this case. Usually the lien will be met at the time of sale. Well what if the Equipment on the poles never gets sold? And to boot, what judge, be it local state or federal will freeze up a tap on the pole preventing inocent customers, including the one where services were performed, from having their accounts serviced when needed? Especialy after their payments have been made.
when you file a Labor lien it's a totaly diferent ball game.
The labor was to provide a service for whom? That's correct, the MSO.Putting a lien on the equipment is damn near impossible at this point. the afore mentioned equipment was never purchased by the technician nor the prime, and being as some poles are owned by the electric companies........ Follow what I am saying?
Bad PR? what has to be considered as bad PR has to be won in a court first. Otherwise The word slander will come to the forfront with a countersuite I'm sure, as it is the prime who owes the tech his/her money. And the MSO has paid out for the work already. True the prime is also liable for said digital boxes, the MSO may still procede with legal charges of theft. wich in this case can be a felony charge.
Example: What is the penalty for stealing or unautherized cable?
If the boxes are returned and final payment is not received for services rendered, you may file for theft of services. You do Not have to live in the area of the prime to get a judgement on them anymore. The county DA where the prime is located will do this for you.
Once you have a judgement you can garnish all business and personal accounts of the prime(provided they are not an INC. then you may go after the business accounts only).The prime then, can NOT close the accounts nor can they withdraw any money or shift the money around untill the garnishment and the fees for the garnishment have been met.This you can do without being in the same state as the prime.But beware, your ducks better all be in a row.
The best way to go about it is to talk to the MSO and have proof of passed QC's and a reciept of equipment turned in.
