And what do you do if the guy/gal does not accept the route? Do you quietly penalize him for the next 3 weeks? Before you answer, may want to check out the IRS website for guidelines THEY set to distinguish subcontractor from employee. If you do quietly penalize him/her you are in violation of IRS set guidelines.The companies and/or contractors will pay dearly if someone with enough guts reports them who do not follow these guidelines set again by the IRS, who by the way was the only government agency able to bring Al Capone down...hint (don't screw with the IRS).
