Chargebacks

I just had a phone call with someone very knowledgable in workplace issues. We spent a little time discussing chargebacks, and the way they are adminstered in cable/sat. According to him companies can not chargeback employees, or employees who are mis-classified as contractors. Its the same as not paying for work performed. If an employee does not perform a job to an employers liking, he can suspend him or even terminate him, but he cant not pay him for work performed. The exception being in sales.

I know Im not thet first person to explore the leaglity of chargebacks, so I was wondering if any of the guys who run companies that chargeback techs could say how this legal.
