I hate to say it but illegal immigrants and independent contractors are "Republican Dream Workers". Congress realized that independent contracting was just a way to avoid labor laws and therefore, put very strict rules on what is necessary to be deemed an independent contractor. Truth is, probably 3/4 of the independent contractors out there really should not be classified as IC's. Do you have to report somewhere in the morning to pick up your work orders at a certain time?? If you do at the direction of the contracting firm you are working for , then by IRS laws, you should be classified an employee and not have to pay that extra 7.5% as well as enjoy vacations and other benefits that normal employees are given.
Trouble is, most IC's won't report because of their conflict of interest.
The IRS takes a dim view of companies that abuse "independent contractors status " and have been known to throw some pretty hefty fines at them
