Back stabbing mso's and contractors

I have one for you.There was this sub that took a month off from work(DSC).When he came back he decided to work for a different contractor that paid more money that did work for the same mso.DSC would not let him go.The sub went to the mso and asked if this was fair.The mso told him that if DSC ran out of work than he could go to work for a different contractor.It seams to me that this should be illegal.Can someone come up with some kind of a legal stand that this sub can hold on to.I am sick and tired of these slimy back stabbing mso and contractors.
