Re: Help with sub non-payment

You can sue him in Michigan if the work was performed in Michigan, any State the work was done, or in his home State. If fact, a nice dirty trick is to just sue him in Michigan and serve him in Texas by certified mail. If he doesn't challenge venue, and he probably won't because he is a low life sleaze, he is stuck under Michigan jurisdiction.

Should be easy to get a judgment especially if you sue him locally where you live. He'll never show up to court and you get a default judgment. When you do, you can then garnish Mastec anywhere since Mastec is a nationwide company. So garnish Mastec right there in Michigan! Or you can garnish any of his other debtors (Cable Prime contractors and/or companies he has worked for or is working for) and collect your money.

Don't worry if the contract you have with him says to sue him in Texas. Again, if you sue him in Michigan and he fails to challenge venue, he is stuck with venue in Michigan and like I said, he probably will never show up or even respond to the suit.

Tip: Go to this site and see if he is registered as doing business as a corporation in Michigan: http://www.cis.state.mi.us/bcs_corp/sr_corp.asp If he is, you can for sure sue him in Michigan and he can't challenge it at all even if he crawled out from under his rock and responded.

Mastec is probably hanging on to a retainer and will hang on to it forever so there should be something to collect.

Kick his behind!
