Here's the answer:

DO NOT 1099 them... To rightfully issue a 1099 they cannot be employees in the eyes of the IRS. They have a list of like 20 questions and if you answer "yes" to any of them - they are considered employees and YOU as the employer will be responsible for paying the back taxes.

Now, the reason they do not like it is they want to avoid paying the taxes, plain and simple. Truely verify the paper work - as said if it is fake - it's on you. You can NOT plead ignorance later.


So, the answer is to "suggest" to one of them they claim "exempt" on their w-2. You as an employer cannot be held responsible for their elections. They will still have wc and social security to pay... wait, maybe not if they are I 9.... check into that with a tax lawyer or whoever does your payroll.

They will still have to pay like 8 or 9 % or something.

Beware the notion of them wary of the w-2's - me thinks they might have bad papers.
