It depends on your non compete and the state you are in, Most states recognize a non compete, They also recognize your right to work in the industry you are skilled.
In most states you are prevented from starting your own company and becoming a prim for the customer that your previous company worked for. You can however get work in your area as a prime through other companies.
In most states you can sub from a prime contractor that has a contract with the same company as your previous employer, but keep in mind that the contracted company can request that you not work in there system to prevent conflicts with the previous employer. This applies more the the cable and Telco industry's to prevent crews from jumping around to other primes on the same job for a better deal and is usually a gentleman's agreement that last's for 30days.
