It sounds as if you were well aware that you were not hired in as an employee. You are working as a subcontractor and you should be responsible for your own insurance. I dont know the actual laws on all of this but in my opinion you should be liable for your own injuries. You make more money as a sub vs being an employee and thats one of the many downfalls of subcontracting. I would not make trouble for the guy you got your work from. It does not sound as if he led you to believe you were an employee so you should have done the checking on insurance coverages. Sounds like a live and learn situation to me.
But that is just my personal opinion.
