Every state is different. Some states require all 1099's to cover themselves with workmans comp. Some states require the general contractor to cover the sub contractor, and some states don't require anything. Normally for the General contractor, if he pays you as a 1099, takes no taxes or withholdings from you, you my friend are out of luck. It doesn't matter if they had you sign a contract or not. A 1099 is a 1099. Why do you think you get paid twice what an employee gets?
As for going afer the homeowner, his homeowners might cover it, but with him paying the deductable. So good luck, you might just want to move on.
