Re: Is this legal???

Just a word for consideration.
With regards to the other replies, take heed. These are words of wisdom.
I have been a prime and subcontractor for many companies and also have been audited by my state. One thing you should do is check through the state that this company is located and see what law states an "employee" versa "contractor". What ever you may have sign does NOT null and void state laws.

I would agree that if you want to avoid alot of legal problems, (I am sure you don't want to spend a lot of time and money even if you are in your rights), find a more honest company to work for.

I have tried to press the responsibility of my employees with penalties for costing the company due to bad workmanship, (I don't care just pay me attitude), but it MUST be within the state laws and clear understandable writing signed by both parties making the agreement.
You must clearly define what is "employee" and "contractor" for there are laws protecting employees from unlawful work conditions and unfair pay practices of employers.

Investigate what are your rights.

Good luck...(wave)
